The multiplier method
Add up your economic losses, then multiply by a factor from about 1.5 to 5 depending on how severe and lasting the injuries are. Example: $20,000 in medical bills + $5,000 in lost wages = $25,000. At a moderate multiplier of 3, that's $75,000 for pain and suffering — a $100,000 total claim.
The per-diem method
This assigns a reasonable daily dollar amount (often based on your daily earnings) for every day from the accident until you recover. It works best for injuries with a clear recovery period.
What pushes the number up
- Severity and permanence of the injury.
- Surgery, lengthy physical therapy, or lasting limitations.
- Emotional distress — anxiety, insomnia, PTSD.
- Loss of enjoyment of activities you can no longer do.
